On 26 May, 2015, the ICANN Board reaffirmed its 2012 request for a Board-initiated PDP to define the purpose of collecting, maintaining and providing access to gTLD registration data, and to consider safeguards for protecting data, using the recommendations in the EWG?s Final Report as an input to, and, if appropriate, as the foundation for a new gTLD policy. Accordingly, the GNSO Next-Generation gTLD RDS PDP Working Group is currently working through phase 1 of the Board-requested PDP, using the Framework?s 3-phase process to (1) establish gTLD registration data requirements to determine if and why a next-generation RDS is needed, (2) design policies that detail functions that must be provided by a next-generation RDS to support those requirements, and (3) provide guidance for how a next-generation RDS should implement those policies, coexisting with and eventually replacing WHOIS. The purpose of this cross-community session is to obtain community feedback on key concepts related to the purposes of gTLD registration data and directory services, data elements required by those purposes, and related data protection and privacy requirements, and access requirements. The WG is currently deliberating on these concepts and hopes to solicit community feedback on its rough consensus agreements to date during this session. The session will include a brief overview of the questions now being addressed by this WG, and the progress of the WG in answering those questions. However, most of the agenda will include an interactive dialogue between the WG members and the broader community on the WG's initial key concepts for users/purposes, data elements, privacy, and access to gTLD registration data, specifically for a 'minimum public data set.' The WG is continuing to deliberate on key concepts and possible requirements for a 'minimum public data set' and plans to expand to other data elements soon. The ICANN Board Governance Committee (BGC) has proposed moving its responsibilities for ICANN's Reconsideration Request process to a new Board committee that can also be dedicated to the oversight of ICANN's other accountability mechanisms as deemed appropriate by the Board. The Reconsideration Request process is a key ICANN accountability mechanism, and the BGC's oversight of it is part of ICANN's Fundamental Bylaws which can only be amended if the ICANN Board and ICANN's Empowered Community (EC) approve. The proposed Fundamental Bylaw change was posted for public comment, following which the Board will review and act on the proposal. If the Board approves the change, the next step (as mandated by the Bylaws) will be for the EC to consider whether it supports the change. The Bylaws specify the process by which the EC may approve Fundamental Bylaw changes. This includes the convening of a Community Forum by ICANN if so directed by the EC Administration. This will be the first time that the EC will be coming together to exercise one of the EC's new powers under the revised ICANN Bylaws. This GNSO Policy Development Process was launched in June 2014 to examine whether changes to the existing dispute resolution processes at the second level in all gTLDs (i.e. the Uniform Domain Name Dispute Resolution Policy (UDRP) and the Uniform Rapid Suspension (URS) procedure) were needed to address the specific needs of international governmental organizations (IGOs) and international non-governmental organizations (INGOs). The PDP Working Group published its preliminary recommendations for public comment and has thoroughly considered the comments received. These recommendations deal with a number of issues, including that of standing to file a complaint under the UDRP and URS and IGO jurisdictional immunity, for which the Working Group had sought the advice of an external legal expert. In this session, the Working Group will discuss its proposed final recommendations with the community. The new gTLD Program established auctions as a mechanism of last resort to resolve string contention (Competition between 2 or more applicants for TLDs). Most string contention sets (approximately 90% of sets scheduled for auction) have been resolved through other means before reaching an auction conducted by ICANN through ICANN's authorized auction service provider. It was recognized from the outset that significant funds could accrue as a result of several auctions. As such, these auction proceeds have been reserved and earmarked until the Board authorizes a plan for the appropriate use of the funds. These proceeds are to be considered as an exceptional, one-time source of revenue. The ICANN community has chartered a Cross-Community Working Group (CCWG) which has been tasked to develop a proposal for eventual consideration by the ICANN Board on the mechanism(s) that should be created to allocate the new gTLD Auction Proceeds. The Cross Community Discussion – Geographic Names at the Top-Level sessions will be a chance for the community to discuss and consider the topic of geographic names at the top-level of the DNS, an area where there are divergent views amongst the community organizations, and even amongst those within their respective organizations. During the 2012 round of the New gTLD Program, country or territory names as defined in the Applicant Guidebook, were not permitted. Certain other Geographic names, as defined in the Applicant Guidebook, were permitted when accompanied with supporting documentation. There are currently several efforts underway that are separately looking at how geographic names should be handled in the future, with some focusing on different aspects of the topic. The New gTLD Subsequent Procedures PDP WG is seeking to facilitate a community-wide dialogue that allows for the community to collaborate, understand the various needs, and to consider and debate proposals to address geographic names at the top-level in future new gTLD procedures; The goal of the session is to work collaboratively with the community to develop a consensus-driven compromise solution. On 26 May, 2015, the ICANN Board reaffirmed its 2012 request for a Board-initiated PDP to define the purpose of collecting, maintaining and providing access to gTLD registration data, and to consider safeguards for protecting data, using the recommendations in the EWG’s Final Report as an input to, and, if appropriate, as the foundation for a new gTLD policy. Accordingly, the GNSO Next-Generation gTLD RDS PDP Working Group is currently working through phase 1 of the Board-requested PDP, using the Framework’s 3-phase process to (1) establish gTLD registration data requirements to determine if and why a next-generation RDS is needed, (2) design policies that detail functions that must be provided by a next-generation RDS to support those requirements, and (3) provide guidance for how a next-generation RDS should implement those policies, coexisting with and eventually replacing WHOIS. The purpose of this cross-community session is to obtain community feedback on key concepts related to the purposes of gTLD registration data and directory services, data elements required by those purposes, and related data protection and privacy requirements, and access requirements. The WG is currently deliberating on these concepts and hopes to solicit community feedback on its rough consensus agreements to date at ICANN59. This session will be led by RDS PDP WG chair Chuck Gomes, supported by vice chairs David Cake, Susan Kawaguchi, and Michele Neylon and by ICANN Policy Staff members Marika Konings, Lisa Phifer, and Amr Elsadr. During this session, the WG will focus on making progress on near-term tasks outlined in the WG's work plan (see https://community.icann.org/x/oIxlAw). There is currently a wide variety of understandings about: a) what ICANN's priorities are b) who is responsible for establishing the priorities Some sense of priorities is available from discussions with the ICANN Board, ICANN Staff, and from the Strategic and Operating Planning framework. But they are all asserting different priorities, and as a result different audiences get different messages. The whole ICANN system (Board, staff, community) would benefit from clear priorities. There would be less risk of volunteer burnout, less confusion about what needs to be done, and less pressure on the ICANN organisation / ICANN staff to meet many and ever-growing needs, if there was an agreed understanding for how priorities are set.
Session goals and expected outcomes Goal: to secure agreement from across the ICANN system about how to establish priorities for the organisation in future. On 28 February 2016, the GNSO Council voted to initiate this Policy Development Process (PDP) and adopted the Working Group Charter (updated from its draft form following work by several Council volunteers) in March 2016 (https://community.icann.org/x/2CWAAw). The PDP is being conducted in two phases, beginning with the Rights Protection Mechanisms (RPMs) developed for the 2012 New gTLD Program, with the 1999 Uniform Domain Name Dispute Resolution Policy to follow in Phase 2. As part of the first phase of this PDP, the Working Group is currently completing its review of the Trademark Claims Clearinghouse (TMCH), and using Sub Teams to assist it in beginning the process to review Sunrise Registrations and Trademark Claims. The Board-GAC Recommendations Implementation Working Group (BGRI-WG) was created to implement GAC-related recommendations of the first ICANN Accountability and Transparency Review Team (ATRT1). Its term was then extended to implement GAC-related recommendations of the second Accountability and Transparency Review Team (ATRT2). The Cross Community Discussion – Geographic Names at the Top-Level sessions will be a chance for the community to discuss and consider the topic of geographic names at the top-level of the DNS, an area where there are divergent views amongst the community organizations, and even amongst those within their respective organizations. During the 2012 round of the New gTLD Program, country or territory names as defined in the Applicant Guidebook, were not permitted. Certain other Geographic names, as defined in the Applicant Guidebook, were permitted when accompanied with supporting documentation. There are currently several efforts underway that are separately looking at how geographic names should be handled in the future, with some focusing on different aspects of the topic. The New gTLD Subsequent Procedures PDP WG is seeking to facilitate a community-wide dialogue that allows for the community to collaborate, understand the various needs, and to consider and debate proposals to address geographic names at the top-level in future new gTLD procedures; The goal of the session is to work collaboratively with the community to develop a consensus-driven compromise solution.
